DELTA AIR LINES® SKYMILES FOR BUSINESS
TERMS AND CONDITIONS
SkyMiles for Business Program Membership
NOTE: As of [November 1, 2023], Delta is sunsetting its SkyBonus program and is replacing it with its SkyMiles for Business program, which is further detailed in these Terms and Conditions. If you are an existing SkyBonus member, please carefully review these Terms and Conditions (and particularly the terms under Enrollment for Companies with Existing SkyBonus Accounts) for more information about how this change impacts your SkyBonus account.
All benefits that Delta offers in the SkyMiles for Business program are conditioned upon acceptance of (and compliance with) these Terms and Conditions, the rules and policies described in the SkyMiles Membership Guide & Program Rules website, the terms and conditions described elsewhere throughout delta.com, all terms and conditions of Delta’s contract of carriage, Delta’s fare rules and all other applicable Delta rules and regulations (collectively, the Program Rules) by each participant. Unless otherwise stated, the current Program Rules in effect at the time of the participant’s enrollment or transaction request will govern that transaction. These Program Rules are subject to change at any time. Delta has the sole right to interpret and apply these Program Rules. Please check back frequently for program updates or rule changes.
Eligibility for SkyMiles for Business Membership and Enrollment
Eligibility Requirements
The Program has three different membership levels for eligible companies: SkyMiles for Business Member, SkyMiles for Business Plus, and SkyMiles for Business Elite (each, a Company Member and collectively, Company Members). The eligibility requirements for each of the Company Member membership levels are set out below:
SkyMiles for Business Member: The Member level of the Program is open to any small to mid-size company (including businesses with an individual owner) based in the United States or Canada with a valid tax identification number (Company) that does not meet the Plus Member Requirements below. This membership level is not eligible for mileage credit (other than mileage credit earned by individual owners and Program administrators using their individual SkyMiles accounts) or Other Rewards (as defined below), but may receive other benefits and rewards as Delta may determine in its discretion, subject to these Terms and Conditions.
SkyMiles for Business Plus: The SkyMiles for Business Plus (or Plus Member) level of the Program is limited to Companies based in the United States or Canada that spend a minimum of $5,000.00 USD in eligible flight revenue (as defined below) each calendar year, and that have a minimum of five unique employee travelers conducting eligible travel each calendar year (collectively, the Plus Member Requirements). This membership level is eligible for the benefits that are available to Members, as well as mileage credit, Other Rewards, and other benefits and rewards as Delta may determine in its discretion, subject to and as further detailed in these Terms and Conditions.
Eligible flight revenue is calculated as base fare and carrier-imposed surcharges, but excluding government-imposed taxes and fees, prorated per flight segment, and rounded up to the nearest whole number. The ticket must be an Eligible Ticket that qualifies for mileage credit in order to count toward eligible flight revenue. Eligible Tickets (as defined below) purchased in a currency other than USD will be converted to USD based on the IATA five (5) day currency exchange rate at the time of ticketing. The Company’s eligible flight revenue will be tracked by Delta and be credited in the year flown (not the year of purchase). Compliance with the eligible flight revenue requirement will be determined based on the eligible flight revenue spent in the prior calendar year. For example, account qualification for 2024 will be determined based on eligible flight revenue from 2023.
Compliance with the unique employee traveler requirement will be determined based on data collected from prior calendar year travelers and travel segments. For example, account qualification for 2024 will be determined based on data collected from 2023 travelers and travel segments.
Qualification for Plus Member status within the calendar year in which the Company Member enrolls in the Program (the Enrollment Year) and the following Membership Year (as defined below) will not be based on the eligible flight revenue or unique employee travelers from the prior calendar year, but will instead be based on eligible flight revenue spend and number of unique travelers and travel segments within the Enrollment Year. Company Members may request Delta to consider, for purposes of calculating eligible flight revenue spent in the Enrollment Year only, the eligible flight revenue spent by the Company Member in the nine (9) month period immediately preceding the date of enrollment (the Prior 9 Month Revenue Amount). Please note that although Delta will count the Prior 9 Month Revenue Amount for purposes of determining the applicable membership level in the Enrollment Year and the following Membership Year, no mileage credit will be awarded for such revenue spent until Plus Member status is achieved.
SkyMiles for Business Elite: The SkyMiles for Business Elite (or Elite Member) level of the Program is limited to Companies based in the United States or Canada on the basis of their eligible flight revenue during a calendar year. To become an Elite Member, in addition to meeting the Plus Member Requirements, a Company Member’s eligible flight revenue must equal or exceed $300,000.00 USD in the applicable calendar year (the Elite Member Requirements). This membership level is eligible for the benefits that are available to Members and Plus Members, as well as 15% more mileage credit per US dollar of eligible flight revenue than at the Plus Member level, and other benefits and rewards as Delta may determine in its discretion, subject to and as further detailed in these Terms and Conditions.
Like qualification for Plus Member status, qualification for Elite Member status within the Enrollment Year and the following Membership Year (as defined below) will not be based on the eligible flight revenue or unique employee travelers from the prior calendar year but will be based on the Enrollment Year Criteria. Please note that although Delta will count the Prior 9 Month Revenue Amount for purposes of determining the applicable membership level in the Enrollment Year and the following Membership Year, no mileage credit will be awarded for such revenue spent until Elite Member status is achieved.
Delta reserves the right to disqualify and to determine the eligibility of any individual or Company for the Program (including eligibility for Program membership level applicable to such individual or Company), and to verify the eligibility of any Company requesting participation in the Program and their respective Program membership level. Delta is the sole arbiter of eligibility and these requirements and rules. Determination of Company base location will be based on the address in the SkyMiles for Business Company profile (as applicable).
There are certain companies and individuals employed by those companies that are not eligible to participate in the Program in any case:
- Companies with an existing CSA, MSA, or similar agreement with Delta or its JV Partner(s) as of the time of requested enrollment*
- Travel agencies (online and offline)
- Wholesalers
- Consolidators
- Metasearch Operators
- Other sellers of travel
- Employees of Delta Air Lines and its subsidiaries (whether as owners or employee travelers)
Delta reserves the right to audit, de-enroll and recover any lost revenue from accounts being used by travel agencies, wholesalers, consolidators, metasearch operators, other sellers of travel, and employees of Delta Air Lines and its subsidiaries.
*Except for Companies with existing SkyBonus accounts (which are subject to a limited exclusion set forth under the “Enrollment for Companies with Existing SkyBonus Accounts” header below), Companies that have an existing CSA, MSA, or similar agreement with Delta or its JV Partner(s) are not eligible to participate in the Program. If such a Company enrolls in the Program, any travel tracked through SkyMiles for Business will not count toward the existing CSA, MSA, or similar agreement, including but not limited to revenue goals, or for mileage credit in the Program; the Company may be disqualified or terminated from one or all programs in Delta’s sole discretion.
Enrollment
To be considered for Program participation, a Company (or its designated travel agency on its behalf) must complete a SkyMiles for Business enrollment form by visiting SkyMilesForBusiness.delta.com. If a SkyMiles for Business account is being created by a Company’s travel agent, or by an employee who is not an officer of the Company, Delta reserves the right to require written proof of authorization from the Company prior to enrolling the Company in the Program.
There is no fee to enroll in the Program.
Enrollment for New Companies (Non-SkyBonus Members)
Where the prospective Program member is a Company not enrolled in the SkyBonus Program, it will be required to provide a valid tax identification number or VAT number to complete enrollment in the Program. Once enrolled, Delta reserves the right to validate the tax identification or VAT number of enrolled Companies, suspend and request corrected information from Companies with invalid tax identification numbers.
Primary Admin
As part of the enrollment process, the Company must designate one employee (the Primary Admin) who will administer the SkyMiles for Business account as the Company’s representative. Eligible employees may not be associated with any other SkyMiles for Business account and must have an individual SkyMiles account, which will be linked to the Company SkyMiles for Business account. For avoidance of doubt, Company designated travel agencies are not permitted to serve as Primary Admin. The Primary Admin is responsible for:
- ensuring participating Company employees adhere to the Program Rules
- advising Delta of any changes to the Company’s information by updating the Company profile on the SkyMiles for Business website
- notifying participating Company employees of the Company’s SkyMiles for Business ID
- requesting and distributing mileage credits and Other Rewards
Secondary Admin
While not a requirement, the Company may also designate another employee as a secondary contact (a Secondary Admin), who will be responsible for administering the Company’s SkyMiles for Business account if the Primary Admin is unable to serve as the Company’s representative for any reason. Like the Primary Admin, this employee may not be associated with any other SkyMiles for Business account and must have an individual SkyMiles account (which will be linked to the Company SkyMiles for Business account) to be eligible to serve as Secondary Admin. Company-designated travel agencies similarly are not permitted to serve as Secondary Admin.
Designated Travel Agent
If the Company prefers to have its travel agent manage its SkyMiles for Business account, the Company can assign this role to its designated travel agent via the SkyMiles for Business website (a Designated Travel Agent). Any travel agent being assigned as a Designated Travel Agent must be registered with ARC or IATA and with Delta Professional. Delta reserves the right to determine eligibility of Designated Travel Agents and/or restrict Designated Travel Agents’ participation in the distribution of SkyMiles for Business.
If a travel agent attempts to enroll a Company for a SkyMiles for Business account without first being designated as a Designated Travel Agent by the Company, a SkyMiles for Business account registration email (the Registration Email) will be sent to the Primary Admin to action. The Primary Admin will be required to “accept” the SkyMiles for Business account registration initiated by the travel agent (who will automatically be assigned the Designated Travel Agent role for the Company as part of the enrollment request) via the Registration Email by linking the Primary Admin’s SkyMiles account number to the Company’s SkyMiles for Business account. Until such time as the Primary Admin links its SkyMiles account number to the Company’s SkyMiles for Business account registered by the travel agent, no mileage credits earned under the Company’s SkyMiles for Business account will be redeemable. Once registered, the Primary Admin will be able to replace and/or remove the travel agent that enrolled the Company for SkyMiles for Business from the Designated Travel Agent role via the SkyMiles for Business website.
The Company hereby authorizes Delta and SkyMiles for Business to correspond with its Primary Admin and (if applicable) its Secondary Admin and/or Designated Travel Agent regarding its SkyMiles for Business account and any flight reservations. Delta is not responsible for any consequences of any actions or inactions of the Primary Admin (or, as applicable, the Secondary Admin or Designated Travel Agent).
SkyMiles for Business ID
Once the Company completes the enrollment process, the Company will be assigned a unique SkyMiles for Business ID. If provided, the Company’s Designated Travel Agent will also receive notification of the SkyMiles for Business ID. As noted above, the Primary Admin is responsible for notifying participating employees of the Company’s SkyMiles for Business ID. It is the traveler’s responsibility to communicate the Company’s SkyMiles for Business ID to their travel agent or to Delta, Air France, KLM, Virgin Atlantic, or Aeromexico Reservations at the time of booking in order for the Company to earn mileage credit.
This assigned SkyMiles for Business ID is to be used solely for business travel by Company employees for purposes of this Program. Any existing SkyMiles accounts of the Company owner(s) or employees will not be merged into the SkyMiles for Business account unless they have created duplicate accounts in the Program.
Enrollment for Companies with Existing SkyBonus Accounts
For Companies with existing SkyBonus accounts as of [November 1, 2023], there is no need to re-enroll following the steps described above for Companies. Rather, the Primary Admins, Secondary Admins, and/or the Designated Travel Agents of these Companies (as applicable) will receive an email announcing the sunset of the SkyBonus program (the Sunset Email) and outlining the steps required to request a conversion of existing SkyBonus accounts into SkyMiles for Business accounts.
Each Company will have 90 days from the date the Sunset Email was sent (the 90 Day Period) to request conversion of its existing SkyBonus account to a SkyMiles for Business account. After the 90 Day Period, all Companies with existing SkyBonus accounts that have not requested to convert to SkyMiles for Business will have their accounts terminated and will no longer have access to their accounts or any accrued but unredeemed points, unless otherwise provided in these Terms and Conditions. Companies who did not request to convert may be permitted to enroll for a new Program Account if they qualify at the time of enrollment, but they will not receive retroactive mileage credit or credit for unredeemed points.
Companies that have requested the conversion of their SkyBonus accounts to SkyMiles for Business accounts within the 90 Day Period will have their accrued SkyBonus points converted into mileage credit under the SkyMiles for Business program – Delta will notify you of the effective date of your conversion via email on or about November 1, 2023. Companies will be eligible to receive one (1) mile for every three (3) unexpired SkyBonus points accrued as of the effective date of your conversion.
As a limited exception to the eligibility terms set forth above, Companies with existing SkyBonus accounts that have a CSA or MSA directly with Delta on or prior to [November 1, 2023] will be permitted to convert their existing SkyBonus account to a SkyMiles for Business account for the limited purpose of converting its accrued SkyBonus points to mileage credit and redeeming such converted mileage credit until fully depleted. Following the redemption of all converted mileage credit, the SkyMiles for Business account of such Companies will automatically be terminated.
Other Terms Relating to Enrollment for Companies
By registering for SkyMiles for Business and creating a SkyMiles for Business account, you agree to:
- Receive all communications from SkyMiles for Business.
- To set communications preferences, please log into your account at SkyMilesForBusiness.delta.com. Go to Manage Account and edit your Notification Settings.
- Delta reserves the right to terminate Company Member accounts that elect to limit or opt out of communications from SkyMiles for Business without notice.
- Share trip information with Delta’s Travel Management Hub in accordance with Delta's Privacy Policy.
All SkyMiles for Business account information, activity, and communications are the confidential information of Delta Air Lines and may not be disclosed publicly or to any third party unless authorized in writing by a Delta corporate officer.
Earning Miles
General Rules for Mileage Credit
Eligible mileage earned under the Program will be credited to Plus Member and Elite Member accounts within eight weeks after qualifying activity occurs, unless otherwise provided in the individual partner’s terms and conditions (for example, it may be as many as twelve weeks for flights on Air France, KLM, Aeromexico, Virgin Atlantic or our other codeshare partners). Partner offers are subject to the terms and conditions of each individual offer. See individual offers for details. SkyMiles for Business partners, offers and benefits are subject to change. Company Members at the Member Tier level are not eligible to receive mileage credit under the Program.
Delta reserves the right to change the mileage posting frequency without advance notice. The Primary Admin and (as applicable) the Secondary Admin and/or Designated Travel Agent will be able to access updated account balances via SkyMilesForBusiness.delta.com.
Mileage credit does not expire. Mileage credit earned and transferred by the Company Member to individual travelers are in addition to miles earned by the individual travelers through the SkyMiles Program.
To ensure credit:
Make sure your tickets are eligible. This means that tickets must be issued for Company Member business travel by Company Member employees (and not for family travel, travel of a personal nature or leisure travel) on a qualifying marketing carrier and itinerary that is purchased and flown after Program enrollment (as more fully described below, an Eligible Ticket).
Eligible Tickets. Eligible Tickets are limited to: (i) Delta Air Lines marketed tickets (flight numbers that include the “DL” airline code) that are validated on Delta ticket stock (ticket numbers beginning with “006”) and are purchased in any authorized Delta ticketing location worldwide, (ii) tickets marketed by Delta Air Lines, Air France, KLM, Aeromexico, or Virgin Atlantic that are validated on Air France (“057”), KLM (“074”), Aeromexico (“139”) or Virgin Atlantic (“932") ticket stock (inclusive of Delta, each a Qualifying Marketing Carrier), are issued in North America, and contain a Transatlantic flight segment, and (iii) Aeromexico marketed tickets issued in North America for nonstop travel between the United States and Mexico. Tickets issued or originating outside North America must be validated on DL 006 ticket stock for Delta marketed and operated flights to be considered Eligible Tickets.
Eligible Upgrades. If the ticket is upgraded through Delta’s post-purchase paid upgrade options, the original ticket must be an Eligible Ticket for the upgraded ticket to earn mileage credit (an Eligible Upgrade Ticket) and the upgrade must not be an Excluded Upgrade (as defined below). Eligible Upgrade Tickets are eligible at the upgraded level for the applicable flight segments. The value of the purchased upgrade will credit to the Company Member account under the ticket number issued as the receipt for the transaction after travel is completed. If applicable, the original Eligible Ticket will be updated to the new earning level after travel is complete. Delta’s post-purchase paid upgrade options are available outside of the 24-hour check-in window on wholly unused tickets, based on availability. Types of upgrades that are not eligible for Program mileage accrual include, but are not limited to, Complimentary Medallion Upgrades, e-First, e-Comfort+, upgrades purchased within 24 hours prior to departure, Mileage Upgrades, SkyMiles Global Upgrades, and SkyMiles Regional Upgrades (Excluded Upgrades).
Exclusions to Eligible Tickets and Mileage Credit. The following are not Eligible Tickets and will not earn mileage credit, unless otherwise specified by Delta: Basic Economy or “Economy Lite” fares (or similar fares offered by partners), tickets validated on other airlines’ ticket stock other than the Eligible Tickets referenced in the Qualifying Marketing Carriers bullet point above, e-Certificates, Award Tickets, Companion Fares, Complimentary Travel/Upgrade Certificates, Senior/Youth Fares, Consolidator Fares, tickets issued by Delta Vacations, tickets purchased under a CSA, MSA, or similar agreement, Meeting Fares, Group Fares, Special Pricing, Military & Government Fares, any tickets for which any ticketing rules have been waived by Delta at the request of the Company Member or the Company Member’s travel agency involving a waiver code, tickets issued by blind-bid purchase online travel providers, such as Priceline.com, tickets issued with unpublished fares, and any other discounts or promotions.
Make sure travel is being booked at the right time. Eligible Tickets, eligible upgraded tickets, and flight coupons must be purchased and flown after the date of enrollment.
Make sure your SkyMiles for Business ID is used at the time of booking or ticketing for each flight.
Where the Designated Travel Agent or Delta, Air France, KLM, Aeromexico or Virgin Atlantic’s Reservations staff complete the booking, they must put the Company Member’s SkyMiles for Business ID in the Tour Code field of the ticket. Delta has no responsibility for Designated Travel Agent ticketing errors and will not offer any waiver codes or retroactive credit to remedy errors.
For travelers purchasing tickets at delta.com, airfrance.com, klm.com or aeromexico.com, they must enter the Company Member’s SkyMiles for Business ID in the SkyMiles for Business ID field on the Passenger Information screen to ensure proper credit is earned. SkyMiles® members can add their or the Company's SkyMiles for Business ID to their delta.com SkyMiles profile so it will automatically be added to tickets booked on delta.com when the Business travel tab is selected.
If the SkyMiles for Business ID isn’t included at the time of booking or ticketing, retroactive credit is allowed for a nine (9) month period for qualifying flights purchased and flown after enrollment date. Primary Admins and, as applicable, Secondary Admins and Designated Travel Agents, may submit up to twenty (20) Eligible Tickets per month for retroactive credit; for any additional tickets, please visit the Resource Center available on the SkyMiles for Business website at SkyMilesForBusiness.delta.com for assistance.
- Delta reserves the right to verify the eligibility of any ticket for which Program mileage credit is sought, which may include, but is not necessarily limited to, requiring sufficient proof of employment for passengers listed on tickets for which Program mileage credit is sought or evidence that travel was for a business purpose. Delta is the final authority on qualification for mileage credit and reserves the right to deduct mileage from SkyMiles for Business Company Member’s account at any time if mileage was credited in error.
Calculation of Mileage Credit
For Plus Members
For Plus Members, mileage earned for air travel completed in each eligible calendar year will be calculated as follows:
- For fares to/from Atlanta, Detroit, Minneapolis, or Salt Lake City:

For Elite Members
For Elite Members, the Elite Member will earn 15% more miles than earned as a Plus Member for each qualifying flight segment flown in an eligible calendar year.
Bonus mile accrual will only apply to base miles earned and not to any additional promotional miles earned. Bonus mile accrual will only apply to qualifying flight segments flown during the Elite Member term and will not be retroactively applied to any flight segments that have already been processed for mileage accrual prior to Elite Member status being earned. In addition to bonus miles, Elite Members will also receive priority servicing for customer service-related matters.
Additional Mileage Credit Terms
The following terms relating to mileage credit also apply:
Mileage credits will be earned following the completion of eligible air travel. There is no mileage cap applicable to Eligible Tickets.
Plus Members and Elite Members are responsible for verifying that mileage for qualifying activity is credited to their SkyMiles for Business accounts. In cases where a Plus Member or Elite Member disputes the number of trips generated or encounters any account discrepancy, Delta reserves the right to require proof of travel, including ticket receipts and original boarding passes. The Plus Member or Elite Member (as applicable) must inform Delta Air Lines, in writing, of any dispute of eligible trips or any account discrepancy within nine (9) months of the original travel date. Disputes should be sent to: Delta SkyMiles for Business, 7500 Airline Drive - MS3-358, Minneapolis, MN 55450-1101 or disputes can be made by visiting the Resource Center available on the SkyMiles for Business website at SkyMilesForBusiness.delta.com.
Mileage credit may be earned through partner offers, according to the terms and conditions of each individual partner or promotion. Mileage credit awarded for partner activity are at the discretion of the partner and must be disputed directly with the partner, not Delta. Revenue spent with partner does not qualify as eligible flight revenue. Mileage credit earned through partner activity are subject to the same validity forfeiture rules as mileage credit earned on flight activity.
Delta reserves the right to establish additional means of earning mileage credits.
Where the eligible air travel reservation consists of multiple segments on different branded fare products, the relevant branded fare product used to determine mileage credit for all of the segments under the reservation will be the branded fare product for the Dominant Segment. As used in this section, (i) Dominant Segment means the longest segment of all segments covered by an eligible air travel reservation, as determined by Distance Flown, and (ii) Distance Flown is the calculated distance between original and destination of each segment covered by an eligible air travel reservation, as determined by Delta in its sole discretion, regardless of the actual distance traveled on any individual flight.
Using Miles and Other Rewards
Using Miles
Primary Admins, Secondary Admins, and Designated Travel Agents of Plus Members and Elite Members can request the transfer of accrued miles from the Company Member’s account to any person with a SkyMiles account designated by the Company Member. These transferred miles can be redeemed by the recipient for Award Travel and many other rewards. The use and redemption of the transferred miles by the recipient will be subject to the terms and conditions of the SkyMiles Membership Guide and Program Rules.
Transfers of miles may be requested online through the SkyMiles for Business website at SkyMilesForBusiness.delta.com. Only the Primary Admin, Secondary Admin or Designated Travel Agent of the Plus Member or Elite Member is allowed access to request the transfer of miles. The Primary Admin and, as applicable, the Secondary Admin of the Plus Member or Elite Member will be notified via email of all requested transactions, regardless of who places the order. The Primary Admin and, as applicable, the Secondary Admin of the Plus Member or the Elite Member are responsible for mileage credit distribution. Delta is not responsible or accountable in any way for mile transfers ordered by Primary Admins, Secondary Admins, or Designated Travel Agents. Please allow up to 2 hours processing time to complete mileage transfer transactions.
Miles transferred through the Program are non-refundable and will not be reversed or redeposited to the Company Member account under any circumstances once a transfer is complete: including if miles are redeemed for Award Travel that is subsequently cancelled or changed. Miles are not the property of any Plus Member or Elite Member or their Primary Admin, Secondary Admin (if any), Designated Travel Agent (if any), or any employee of the Plus Member or Elite Member.
Mileage transfers may not be available in all markets or geographic areas. Eligible Company Members are limited to transferring no more than one million (1,000,000) miles from its SkyMiles for Business account per calendar day. Any requests for miles beyond this daily limit may be rejected at Delta’s sole discretion and will not be transferred from the Plus Member or Elite Member’s account or posted to any recipient’s account.
Using Other Rewards
In addition to transferring accrued miles to other individual SkyMiles account holders, Primary Admins, Secondary Admins, and Designated Travel Agents of Plus Members and Elite Members may redeem accrued miles for certain other rewards available as part of the SkyMiles program (Other Rewards) as Delta may designate from time to time.
Other Rewards will be issued to the Plus Member or Elite Member (as applicable) and sent to the designated Primary Admin (or Secondary Admin, as applicable) and may be utilized by the Primary Admin (or Secondary Admin, as applicable) or allocated to any person with a SkyMiles account designated by the Plus Member or Elite Member.
Other Rewards may be requested online through the SkyMiles for Business website at SkyMilesForBusiness.delta.com. Only the Primary Admin, Secondary Admin or Designated Travel Agent of the Plus Member or Elite Member is allowed access to request the Other Rewards. The Primary Admin and, as applicable, the Secondary Admin of the Plus Member or Elite Member are responsible for Other Reward distribution. Delta is not responsible or accountable in any way for Other Rewards ordered by Primary Admins, Secondary Admins, or Designated Travel Agents.
Other Reward mileage values and menu options are subject to change at Delta’s discretion and without notice. Other Rewards redeemed through the Program are final and will not be redeposited under any circumstances once a redemption is complete. Lost, stolen, destroyed, expired or unused Other Rewards will not be replaced or credited to the Plus Member or Elite Member’s account. The sale or barter of any Other Reward by the recipient is prohibited. Other Rewards obtained through prohibited sale or barter transactions are void, invalid of travel, and will be confiscated. Other Rewards are not the property of any Plus Member or Elite Member or their Primary Admin, Secondary Admin (if any), Designated Travel Agent (if any), or any employee of the Plus Member or Elite Member. All tax liability associated with the receipt and use of Other Rewards is the responsibility of the Plus Member or Elite Member (as applicable). Other Rewards redemptions are subject to the terms set forth at the time of redemption.
Limitations
The Program and all associated benefits may not be combined with any other Delta discount program, including but not limited to any bonus commission programs or certificate programs, unless otherwise specified in the Program Rules. Unauthorized combinations will result in a debit memo.
Changes in Program Membership Levels for Company SkyMiles for Business Accounts
Program membership at any level runs from February 1 to January 31 of the following year (a Membership Year), and the determination of a Company Member’s membership level is based on account activity in the immediately preceding calendar year (except in the Enrollment Year, in which the Enrollment Year Criteria will be used) (the Measurement Year). Unless otherwise provided herein, a Company Member’s membership level does not automatically carry over for subsequent Membership Years. Change in Program membership level is subject to meeting (or failing to meet) eligibility requirements for other Program membership levels as set forth below:
For Members: If a Member meets the Plus Member Requirements or Elite Member Requirements by the end of any Measurement Year, the following terms apply:
Where the Plus Member Requirements are met, the Member will be deemed a Plus Member for the then-current Measurement Year and the immediately following Membership Year and will be eligible to receive mileage credit for eligible flight revenue generated on qualifying flights taken through the end of the following Membership Year. These mileage credits are eligible for transfer or redemption for Other Rewards from the date the Plus Member Requirements are met (subject to additional terms below).
Where the Elite Member Requirements are met, the Member will be deemed an Elite Member for the then-current Measurement Year and the immediately following Membership Year and will be eligible for Elite Member benefits through the end of the following Membership Year.
For Plus Members: If a Plus Member:
meets the Elite Member Requirements by the end of a Measurement Year, it will be deemed an Elite Member for the remainder of the then-current Measurement Year and the immediately following Membership Year, and will be eligible for Elite Member benefits through the end of the following Membership Year.
fails to meet Plus Member Requirements by the end of a Measurement Year, the Company will be considered a Member and will be ineligible to accrue new mileage credits in the following Membership Year (De-Qualification) and in any Membership Year in which the Plus Member Requirements are not met. However, during this De-Qualification period, the Company may redeem any previously accrued mileage credits.
If a Member subsequently meets the Plus Member Requirements in any Measurement Year, it will again be considered a Plus Member as of the immediately following Membership Year and will be entitled to earn mileage credit for qualifying flights taken during the following Membership Year.
For Elite Members:
If a Company Member fails to meet the Elite Member Requirements by the end of any Measurement Year, it will be considered a Plus Member (so long as the Plus Member Requirements have been met) from the start of the immediately following Membership Year and will no longer be eligible for Elite Member benefits from the start of the immediately following Membership Year until the Member once again meets the Elite Member Requirements.
If a Company Member fails to meet the Elite Member Requirements or the Plus Member Requirements by the end of a Measurement Year, the Company Member will be subject to De-Qualification, as set forth above.
If an existing SkyBonus account holder with Elite status elects to enter into a CSA or MSA with Delta in lieu of converting its SkyBonus account to a SkyMiles for Business account, the Company Member will retain Elite Member status through the end of the then-current Membership Year.
Please note, ticket removals or cancellations during a Measurement Year may cause a Company Member to be moved to a lower Program membership level for the following Membership Year in accordance with the eligible revenue and unique traveler requirements.
Program Changes and Termination; Termination of Accounts
Program Changes and Termination
Delta and its Program partners reserve the right to change any aspect of the Program including without limitation these SkyMiles for Business Program Rules, the general SkyMiles Program Rules, benefits, mileage accrual rates, Award Travel, and special offers at any time without notice. This means that Delta may initiate changes, for instance, impacting partner affiliates, rules for earning mileage credit, rules for transferring mileage credit, continued availability of Other Rewards, blackout dates, cities served, flight schedules, limited seating or space availability, and specific features of promotional offers. Such changes to the Program may include modifications that (i) govern mileage credits, Other Rewards or other benefits earned on or after the date of change or (ii) change the value of already accumulated mileage credits, Other Rewards or other benefits.
All benefits of the Program are offered at the discretion of Delta, and Delta has the right to terminate the Program, in whole or in part, at any time on 90 days’ prior notice. Should the Program be terminated, each Company Member’s right to earn mileage credit and request Other Rewards or other benefits will be terminated 90 days after notice is given.
Termination of Company Member, Primary Admin, Secondary Admin, and/or Designated Travel Agent Accounts and Membership
Outside of its right to terminate the Program (as described above), Delta reserves the right to terminate or de-enroll membership in the Program and/or associated Program accounts at any time, with or without notice, as follows:
Where fraudulent activity occurs
Where a Company Member or its Primary Admin, Secondary Admin (if any), Designated Travel Agent (if any), or any other employee of the Company Member violates the SkyMiles for Business Program Rules or the general SkyMiles Program Rules, or any ticketing or fare rules
Where an individual traveler of a Company Member uses the Company SkyMiles for Business Program number for personal (non-business) travel or is not an eligible employee of a Company Member
Where a Company Member requests an account closure
Where a Company Member or its Primary Admin, Secondary Admin (if any), and/or Designated Travel Agent (if any) does not respond to repeated communication attempts regarding the status of the Program account
Where a Company Member is organized or relocates to a country where membership is prohibited under applicable law
Due to any misrepresentation of any information provided to Delta by a Company Member, or its Primary Admin, Secondary Admin (if any), or any other employee of the Company Member
Where a Company Member, or its Primary Admin, Secondary Admin (if any), Designated Travel Agent (if any), or any other employee of the Company Member abuses any Program privileges
Where Delta, in its sole discretion, believes that a Company Member or its Primary Admin, Secondary Admin (if any), or any other employee of the Company Member is involved in or associated with any activity that could negatively affect the goodwill or reputation of Delta or that disparages or brings Delta into disrepute
Where a Company Member elects to update its communication preferences to limit or opt-out of receiving communications from SkyMiles for Business
Termination of Program membership will result in a loss of all accumulated mileage credit in the Company Member’s account and the loss of all other Program benefits. Terminated Company Members are not eligible to participate in any aspect of the Program, including without limitation any special promotions or Program partnership offers.
Where Delta terminates the account of any Primary Admin, Secondary Admin, or Designated Travel Agent participating in the Program due to fraudulent activity or violation of the Program Rules (each, an Offending Party), Delta additionally reserves the right to terminate any individual SkyMiles account the Offending Party may have (which will result in a loss of all accumulated mileage credit in the Offending Party’s SkyMiles account and any other SkyMiles program benefits) or to deduct any transferred mileage credit to those accounts from the Offending Party’s account or relating to the behavior leading to Program account termination. Terminated Offending Parties are not eligible to participate in any aspect of the Program or the SkyMiles program, including without limitation any special promotions or Program or SkyMiles program partnership offers.
Company Members (or their Primary Admins, Secondary Admins, or Designated Travel Agents) whose accounts have been terminated for any reason may not reopen new accounts.
Void Where Prohibited By Law
The Program, mileage credits, and Other Rewards are subject to all government regulations. Some or all parts of the Program may not be legal in certain countries. Consequently, the Program is void where prohibited by law.
Governing Law, Jurisdiction, and Waiver
The rights and obligations created by the Program will be governed by the laws of the State of Georgia, without giving effect to that jurisdiction’s principles of conflicts of laws.
All disputes arising out of or related to these Terms and Conditions, the Program Rules or the Program shall be resolved exclusively in the state or federal courts of competent jurisdiction located in Fulton County, State of Georgia, United States of America. As a condition of participating in the Program, the Company Member, the Primary Admin, and (if applicable) the Secondary Admin, irrevocably submit to the jurisdiction of such courts to the exclusion of all other courts or tribunals, wherever the same may be located.
Delta may enforce its Program Rules at any time, and its election not to enforce any or all rules does not operate as a waiver of its right to do so at any time in the future.
